    Default Hvxp work or road drivers work

    July 2008 HVXP run started out of our terminal with a guy transfering into our terminal to take this position as per agreed to by the company and union. November 2008 run supposedly canceled and was being still ran everynight but now with line haul, the guy who transfered into the terminal for this being laid off and filed a grievance and still as of Sept 11 2009 grievance still not been heard by the union commitee. Anyone else having problems with the grievances not being heard or settled. What is the timeframe for hearing or settling these grievances as our BA says its still on the books and thats all he knows, but hes never around to answer questions and never returns phone calls.

    30 days. It is in the NMFA. I believe it is article 7 The Grievants Bill of Rights.

    The next paragraph after the one you cited states that the Company and/or the Union can postpone the grievance one time and reset it for the next agenda.

    I would guess that most Committees have long standing agreements on how the postponements work in that area.

    Isn't there supposed to be a special panel for all utility grievences? We have 3 at our barn that were filed back in Jan & Feb and to our knowledge still have not been heard.

    I was gonna add that Utility grievances aren't decided at the state or even the JAC level. They could take months to be heard.

    maybe they figure if they wait long enough they will forgotten about or been laid off so long a guy would begin to enjoy the layoff.

    by the way still waiting for our new contract books maybe the BA's haven't gotten theirs yet either so they don't know about the thirty days as Muler says.

    There is a utility grievance panel but that still does not change the time for which a grievance will be heard. Now I would ask to see the paper work that was submitted on my behalf to the proper panel. If the BA can not produce the filing I would have his @ss.

    There will be no Utility grievances heard until the panel decides to convene. It's not up to the local BAs to decide that. It's over their heads. I think the last time they heard Utility grievances was late last year in Branson, Mo......maybe somebody else knows differently and if so I hope they can say when the last one was held. Tiredseat, I think you're BA is telling you the truth. Is Jim your BA or Danny ?

    Now does that sound right. The last panel was held almost a year ago. I my self would have contacted someone at the IBT. If that is the case then there is another mistake from the IBT. A year or more to get a grievance heard. Do you think that is right ?
