    Default Vacation Time

i was laid off for a period of time and only got 144 trips in for the year. They tell me that i am not able to take time off because i did not get 188 trips. Is this true? They tell me that i can get some pay but no time off. This seems to me not to be fair. I was reading in the national master freight aggrement that you can count days that you were available but did not get called. Any info on this would be helpfull. Thanks

I do know that you have to physically work a set amount of days to earn vacation.

I believe its 156 tours that is the magic number. I was off work for several months last year with surgery and instead of picking my vacation up when i usually do it was about a month and a half late and the magic number was 156.

You have to work 60% or more of the total working days during any 12 month. When they tell you 188 trips they are saying 365 - 52= 313 x 60%= 187.8 so depending how long you worked there they have to pay you about 76.6 % of 188 = 144 days which if you worked there a least one year they owe you 76.6 % of 6 days = 4.596 days of pay

We are not in the NMFA but some of our contract is pretty similar. Our contract says 156 reports before vacation is awarded.

I am in central states. I know they owe me a percentage of pay but they are telling me that i cant take the time off none so i basically have to go 2 years with no payed time off. I have been there 4 1/2 years.
