you may have to work 90 days into the contract year to get paid for them thats why we did not get them when red star shut down we have that going on now because guys are retiring and the company said we will not pay you out right for them so guys are using them before they leave

In addition, no employee will lose their entitlement to the cash out of unused sick leave on January 1, 2009, because they were not able to satisfy the present eligibility provision of having received 90 days of compensation during the shorten qualifying period of April 1, 2008, through December 31, 2008.
The additional sick leave days referred to above shall also be included in those Supplements containing sick leave provisions prior to April 1, 1976. The National Negotiating Committees may develop rules and regulations to apply to sick leave provisions negotiated in the 1976 Agreement and amended in this Agreement uniformly to the Supplements. The Committee shall not establish rules and regulations for sick leave programs in existence on March 31, 1976.


So what do you guys think?

This was taken from Local 728
From what you have posted, you would not be paid in Central States due to not working 90 days. Sorry I know that was'nt what you wanted to hear.

I worked fulltime for ABF until January 14th 2009, I was told I would get my unused sick pay because I was a fulltime employee, although it was only for 14 days of the entire year. But now they say no and I would like to read the contract again before I call the BA.

At 622/STL you had to work a minimum of 90 days in the contract year, now the calender year, to get paid for unused sick days. I never had to worry about it because mine were usually gone in the first month of eligibility.

I once sit across from a Labor rep at the panel and tried to appeal to their sense of morality about screwing an employee for coming to work. I got an eye opener that day. Learned my lesson. It was way easier fighting excessive absentee than trying to get what a guy has'nt used. Reminded the TM everytime too.

I know the feeling Wolf. I always encouraged guy to use their sick days. Until about 2 or 3 years ago it was never much of an issue with us because everybody worked a hell of a lot more than 90 days each year. When one guy found out the 90 days a year deal he didn't like it and somehow it was all my fault.....I'm sure you can relate. It's a damn shame that guys aren't even getting 90 days. It's got to get better.

Thank you to everyone. I didn't think I would get the unused sick pay but I have a few former co-workers who tell me differently. I thought I wouldnt get paid for it but was hoping otherwise. Thanks again.

In the west all you need is 1 punch in 15 days prior to the holiday to receive holiday pay.
