    ABF Freight System, Inc. Disagrees With Federal District Court's Ruling - Yahoo! Finance

    FORT SMITH, Ark., Aug. 1, 2012 /PRNewswire/ -- ABF Freight System, Inc., one of the nation's largest less-than-truckload carriers, on Wednesday said it disagrees with, and is disappointed by, today's District Court ruling dismissing its lawsuit against the International Brotherhood of Teamsters and other parties for violations of the National Master Freight Agreement.

    I don't want to see ABF win the lawsuit but I think that Judge Wright should have let ABF have it's day in court. I'm probably just being mean spirited and looking for revenge against Hoffa & co. for the way they handled the last NMFA contract. But it still eats away at me how they scammed the ABF Teamsters into voting for a contract we were not even a party to.

    U.S. District Court Judge Susan Webber Wright has again ruled against Arkansas Best Corp. in the trucking company’s attempt to pursue a $750 million claim against the International Brotherhood of Teamsters and other parties.

    Arkansas Best issued a statement Wednesday (Aug. 1) saying they were “disappointed” by Wright’s ruling, and indicated they are considering a second appeal of her dismissal.

    “ABF is studying the ruling and evaluating its options which include, among other avenues, taking a second appeal to the Eighth Circuit or refiling the case in the District Court,” the company noted in its statement.

    I was never happy about the lawsuit. As far as the contract and how they went about it, I had no idea what was going on back then as I believe that took place right about the time husband was laid off. We were in the dark until I joined this site. I do think ABF will use this situation to ask for concessions.

    Yes Hoffa and co threw the NMFA Teamsters under the bus with the UPSF stand alone contract. IMO the ABF Teamsters will be in a weakened position due to poor representation at the bargaining table. IMO Hoffa & co have little love and respect for the ABF Teamsters because we voted down the give backs.

    “The harsh reality for ABFS is that they are currently at a competitive disadvantage, one largely created by the same Union that collects dues from ABFS' Teamster employees, and there’s a strong likelihood that this competitive advantage will remain for an extended period of time unless some drastic steps are taken by outside forces,” Waldo wrote in a 2010 investor note. “Unfortunately for ABFS, the eventual outcome of trying to remedy this situation is largely out of their hands.”

    IMO ABF will not negotiate through TMI. Since Tyson seems to be having less responsibilities lately he will probably try and play hard ball in the seperate ABF contract negotiations. I doubt that many will be happy with the outcome.

    Judge again dismisses ABF suit against Teamsters

    One of the reasons Wright again dismissed the suit was her opinion that ABF had not followed all the procedures available outside of the courts.

    “ABF, not the Union, stopped the grievance procedure from moving forward by filing this action. Nor does the Court find that the Union’s actions have prejudiced ABF. The parties have not engaged in discovery or litigated substantial issues on the merits, and it would not be inequitable at this stage to require ABF to proceed under the grievance procedure,” Wright noted in the opinion issued Wednesday (Aug. 1).
