    i was terminated recently because i forgot to inform my employer that i would return the next day after calling in. we have a policy that says if you called in today u have to let them know before the end of the shift that you will return the next day.

    now let me give you some info of my history with the company. i have only been with the company for a year.
    about six months back i was suspended for bringing a cellphone in to the facility, i didnt use it but i did take it out of my pocket and look at it and was caught by a supervisor. i got 3 days suspension, while other employees got sent home and return to work next day. thats the first time i ever got in any trouble.

    on early march i came back late on lunch and punch in on time but i had to go back to my car and get my shirt uniform. as i got it , i came back into the premise and begin putting on and talk to another employee. i sat down on the bench for a second and the manager saw me and he fired me because he said i was stealing company time. when he call me in i told him i was just gonna finish my soda and go back to w0rk and that i need to put my uniform on. I dont think it even take more than 5 or six minute the whole process. i was re instated and given a final warning to not violate any company polices. i believe that was quite harsh, because he clearly saw me without my uniform and i had to go out for lunch and that day there were a bit more traffic as usual. i accept the final agreement and didn't plan to violate anything.

    on saturday, the mothers day weekend i called in and forgot to let them know that i would return the next day. so when i return to work the next day i was sent home and told to come back the following day. when i return the following day i was suspended indefinitely and terminated. It did happen to me before that i forgot to let them know and was sent home too but that was it. I didnt know about that policy as most other works you only let them now if you are going to miss the following days. Also when i called out for the first time they didnt send me home or say anything. Now the accusation on this was that i intentionally didn't let them know that i was going to return the next day (mothers day) so that they can send me home. they accused me of deliberate mis-use of time off. I just genuinely forgot to let them now about it, if they never mention any disciplinary action to me on my previous incident and i never saw any memo about this policy, i dont see how the union can let them terminate me. I mean i didn't intenitonally do it, just because we know of such policy dont mean that we wont forget about it at some point.

    This termination is, in my believe that he just dont like me. He believe or thinks that i really do that intentionally to get sent home on mothers day. If i wanted that day off i would just called in both days and would only still accumulate 1 points only. We went to the panel and i lost which is expected. theres two panel member from the company and 2 member from the union. we already know his buddies from the company is going to vote against me. They brought all those previous incidents up and also brought some informations that weren't even correct against me. I never went to a panel before so things got a bit confusing when i try to explain my case. But they really brought some faacts out that were wrong. But the main thing is that final agreement i took and they said i violated that. If its an accident how can i violate anything, even the manager mention that when i sign that agreement if i had accidents at work thats not a violation but if i did something wrong thats different. So this termination is strictly based on him thinking that i deliberately called in the day before and not mention to them that i would return the next day. If the supervisor would ask me i would tell them yes, but he never as me and i forgot. maybe because im not close to my supervisors but they always ask most of the employees that if they are going to return the next day. Theres also no answer machine so when you call in you have to speak to a supervisor. So when they ask me why i call in, i gave them a reason and forgot to mention of my return to work.

    So my question to you brothers is, should i even try to fight again? I believe the panel was to see if we should go to arbitration if we can win the panel, which i doubt we would. they brought out too many things that werent correct so i spend too much time addressing them and little time stumbling about what they really fired me for. So should i still try ask my agent to go arbitration? he already said we dont have a good chance because of the final agreement. Im just really pissed, that i left a great job for this and felt like they are really bias toward me. just because it happen on m others day and he acussed me of intentionally doing it.

    First all "WELCOME" to Teamstersonline.. I believe you should stay in touch with your BA and tell him you want to go to the panel.. At this point you really haven't anything to lose.. You stated they gave false information at your company meeting..This would be a starting point.. If they lied you should be able to prove it.. Again talk to your BA and your Shop Steward.. In the mean time you might want to go out and find something else.. One thing I cannot ever figure out about these companies is that they hire people so they can fire them.. Yours is not the only company that does this.. Good luck!!

    we have already did the panel at the union hall and they have voted to uphold the the decision. And yes this company does hire people to fire them. A friend of mine was hired few months back and before he made his time they let hiim go. That manager that fired me is known to give favoritism to people he knows and fire those he believes that dont follow his policies. on mine incidents, they could have maybe write me up, but a termination and suspensions are pretty harsh.He allow a new guy to missed 3 months of work because hes a friend with the guys father, even though the guy has a medical excuse but he still a new guy.. If anyone else who hasn't passed their probation and have to leave on medical issue, i guaranteed they are fired.
    as far as the job, im not even sure if i wanna go back and even if i do i will not have the same feelings for it. I just want to prove that he is wrong about the accusations, also kind of have mix feeling about the BA as most people think he's too close to the company manager.

    FMLA they can't fire u for that. I wouldn't want to work for a place like that anyway. I'd rather work at a non union company than what your describing!

    From what he describes I've never heard of being fired on the spot for being late. But you should not clock in for lunch till your ready go back to work then they can't fire you. Sounds like a great company to work for...I worked at nonunion company that wouldn't do that

    what I want to know is, I already lost at the panel which is to see if we can get enough vote to go arbitration or if we should continue. THe process involve 2 members from the company and 2 members from union who act as panel. I already know the companys panel or member was not gonna vote in favor of me. So there is no way to win that panel. But I want to know if we can still go arbitration even after the panel. I don't believe we were aggressive in the panel, and some informations the company brought against me is false and also some irrelevant informations that was used against me that was lead to my termination.

    If you can prove that the allegations are false than bring them to the BA. If he doesn't help then go beyond him.. But make sure you have the proof.. If not look for another job.. Then again are you sure you really want to work there.. It seems they would have you under a microscope.. Your other alternative is to go to the NLRB. But then again make sure you HAVE the proof... Good Luck...

    The panel I was talking about is called "board of adjustments" and I lost that because I was confused with the evidence they brought up and some that weren't true. Its hard going into a meeting without any information ahead of time, and my BA didn't inform me of how it works, I got a 10 minute briefing right before the panel meeting of how the process goes. But I talked to the BA and he said since I lost that we can't go arbitration and that's the end of it, but can I appeal that "BOA" decision?

    Also to answer you question whether I want to work there again, I do and I don't, but since this manager attacks my integrity and I want to prove that he is wrong and he lied.

    I think I'd talk to your BA. His hierarchy, Local President, maybe who he deals with...such as an IBT negotiating committee man. In Freight we also have Regional Freight Directors and Assistants which I might become annoying too.
