    Police say trucker was tired, watching porn when fatal crash occurred

    The driver of a tractor-trailer was watching a pornographic movie and had been on the road too long when he smashed into a disabled car last month on the Thruway, killing the driver, state police said Wednesday.

    Vinnie Politan highlighted this on CNN yesterday.

    Investigators determined that Wallace was driving on no more than four hours of sleep and had been on duty for 27 hours prior to the fatal crash, in violation of federal regulations that limit the hours of commercial drivers, State Police Capt. Michael Nigrelli said.
    What I'd like to know is how they determined this. He couldn't have been dumb enough to log 27 hours on duty, and have a 6 year clean record........

    You wouldn't think so.

    As the articles in the Buffalo News stated, EZPass records, toll booth surveilance camera footage, Millis Company records (which will probably include Qualcom tracking records of the vehicle) have all been subpoenaed. These records will without a doubt tell how long he had been driving, all else at this point is speculation.

    Having said that, the evidence regarding his laptop, will help seal the drivers fate.

    Seeing that December 12, 2009 was a Saturday, traveling westbound on I-90 towards his home in Ohio, one could speculate that he wanted to get home for whatever was left of the weekend.

    This is a very tragic event for all involved and further emphasizes the reason why no company can force you to do anything that is in direct violation of the law and DOT hours of service regulations. If you do and something like this happens not only the driver but the drivers family and all involved will suffer.

    And if the company did force him to run in violation this is another reason to organize as there still are some companies out therethat don't care about the laws only the bottom line on theie books until something happens and then it was the driver and the company had no idea this was happening
