I don't believe they can go after the driver .. His poor wife already has enough on her plate .. She doesn't need this on top of it.. And again it was probably an ambulance chasing lawyer that got this started..

I was involved in an accident over 20 years ago, straight truck turned in front of my 8 axle Mack Superliner Truck/Pup at intersection, was enable to avoid and side swiped him destroying the front end of my truck and minimal damage to him as i hit the flat bed steel deck, long story short we went to court, owner was unprepared thinking the ball was in our court, not only did he win a settlement but his wife got $23,000 for loss of companionship due to his "injuries" couldnt fulfill his husbandly duties. The bottom feeding ambulance chasers will put their hand in every pocket,we can only hope Mr Evans was not personally responsible, equipment failure etc but if he was texting or distracted it doesn't bode well for his estate, been telling younger drivers for years you can lose everything should this or something similar happens.
