    Default Shaw’s fights Teamsters’ effort to unionize Maine pharmacists

    PORTLAND, Maine — Shaw’s Supermarkets is fighting an effort by the Teamsters union to organize the chain’s pharmacists at 16 stores in Maine, arguing its pharmacy managers are supervisors and therefore are not able to join a labor union.

    The dispute is before the National Labor Relations Board, which held a hearing Jan. 29 after the unions petitioned Jan. 20 to represent all full- and part-time registered pharmacists and graduate non-registered pharmacists in Maine.

    Traci Place, a business agent with Teamsters Local 340, said the union does not represent any other workers at Shaw’s and the union recruitment effort underway is “in the very early stages.”

    Shaw’s Delivery Drivers and Mechanics Vote to Join Teamsters Local 340


    (WELLS, Maine) – Employees at the Shaw’s distribution center in Wells, Maine have formed a union with Teamsters Local 340, due to an organizing election that took place on March 1. The workers are seeking job security and disciplinary due process, in addition to a contract that will protect their wages, benefits and working conditions from the uncertainties of the corporate workplace.

    “A lot of campaigning went into this victory,” said Local 340 President Brett Miller. “There was hard work required not just this winter, but in previous years as well. We had to overcome the company’s legal roadblocks in hearings at the National Labor Relations Board, before finally triggering a representation election. We commend the men and women of Shaw’s for their bravery in standing up to the company to demand a fair contract with the guaranteed employee rights and wages they deserve.”

    Teamsters Local 340 Members at Shaw's Trucking Ratify First Contract

    (SOUTH PORTLAND, Maine) – Teamster drivers and mechanics at Shaw’s Distribution Center in Wells, Maine, overwhelmingly ratified their first contract on October 24.

    The 79 members work for Shaw’s, delivering product to Shaw’s grocery stores throughout New England.

    The group sought union representation and now has a new two-year contract that provides a grievance process; seniority rights in regards to bidding routes and work schedules; and guaranteed pay increases in each year of the contract. The group had not received any wage increases in the past four years.

    “Congratulations to our negotiating team. They proved to be knowledgeable, courageous and united. They should be proud of their work,” said Brett Miller, President of Local 340. “They endured months of anti-union tactics and pressure, but never gave in.”

    The drivers were able to organize. The decision went to the other way for the pharmacists. See post #1.

    Maine staff pharmacists join Teamsters
    Twenty staff pharmacists at Osco Drug pharmacies inside 16 Shaw’s Supermarket stores in Maine recently voted to join Teamsters Union Local 340.
    In March, the National Labor Relations Board ruled that 16 pharmacy managers at the Shaw’s stores were supervisors and thus not eligible to join the union. Shaw’s management successfully argued that some of its pharmacists are supervisors and not eligible to join a union because they hire, discipline, and fire employees. Additionally, 35 pharmacy technicians at the Shaw stores were also excluded as agreed by the employer and the union.
