Default Labor Department sets repeal of ‘persuader rule’ in motion

I will say it again. Trump is all for the working man..............

On June 12, the U.S. Department of Labor will publish a Notice of Proposed Rulemaking to rescind a rule that would have required employers and labor-management consultants to report consultants’ indirect contact with workers during union organizing campaigns.

The rule, approved in March, applied to Section 203 of the Labor Management Reporting and Disclosure Act. It requires that labor organizations, consultants, and employers file reports and disclose expenditures on labor-management activities. The law is intended to prevent abuse, corruption, and improper practices by all parties.

What the Labor Department termed “a longstanding loophole,” however, allows employers to hire consultants to create materials, strategies and policies for organizing campaigns—and even to script managers’ communications with employees—without disclosing those arrangements, as long as the consultant does not directly contact employees.

The page that was ripped from the busters handbook neatly taped back into the book for them.

This is what it all boils down to.

There is a great dissonance to the judge’s extreme sensitivities to the rights of lawyers, union busters and employers to have their anti-union activities shrouded in complete secrecy, when the new rule was intended to protect workers’ rights. Not mentioned anywhere in the judge’s 86-page order is any discussion of workers’ rights to know who is really speaking to them when they are forced to sit in on an anti-union captive audience meeting. Further, there is no discussion of the value to workers of being able to test the employer’s claim that it does not have money to provide extra pay or benefits, when it might be spending tens or hundreds of thousands of dollars on anti-union consultants.

Union busting is the main reason that multinational coroprations and banks are the only people making policy in DC.....and they have piss poor results for our nation.

The anti-union policies are LOSER policies.

Another 5 years, at least stolen from American workers.
How much can workers take before it's time to go back to uglier ways to get things done...They obviously do not allow for any civil ways for us to have a way to make a living.

The Trump Administration Wants To Hide Union-Busting By Employers
WASHINGTON ― American companies shell out millions of dollars a year to lawyers and consultants whose job is to kill union-organizing campaigns. Much of that work is done in the shadows, and the Trump administration is looking to keep it that way.

In a blow to unions, the Labor Department on Monday proposed rescinding what’s known as the “persuader rule,” a regulation that would ramp up disclosure requirements for employers who hire anti-union consultants. The Obama administration proposed the persuader rule last year in order to bring more transparency to a profitable industry known colloquially as union-busting.

For decades, employers have had to report to the government when they hire an outside consultant ― i.e., a “persuader” ― to try to sway employees on the question of unionizing. But under Labor Department rules, employers only have to disclose when their consultants communicate directly with employees. They don’t have to report any indirect “advice” they pay for.

DOL Takes a Wrong Turn for Workers

The worker victories weren’t always headline stealers during the Obama administration. But they added up.

A rule requiring companies to document their outside union-busting tactics, as well as positive determinations when it came to stopping the anti-worker actions behind independent contractors and joint employment, were decisions that had the potential to enhance the collective bargaining rights of workers and raise wages.

But last week, the U.S. Department of Labor (DOL) decided to reverse them. It was a surprising move for an administration that insists it sides with workers. Teamsters General President Jim Hoffa called the decisions “greatly disappointing.”

The “persuader rule” called for outside consultants and attorneys hired by companies to crack down on union activities to be treated the same as employers who must disclose such activities under the Labor Management Reporting and Disclosure Act of 1959. And it also increased parity with unions, which are already required to file detailed financial disclosure forms each and every year that includes receipts and expenditures.

While the Obama administration issued the rule in early 2016, it never took effect. A federal judge permanently blocked it from being implemented last November. That halted it from shining a spotlight on companies who employ third-party actors to intimidate workers in an effort to halt union organizing efforts.
