    Question Lunch Breaks

    What are the federal requirments...company rules..There was a discussion that you "will" take a lunch...now...I would like to see that on paper and in black and white..as I see it the magical word is"may"....

    ..if you have any pcm that states company policy that would be greatly appreciated..

    Pm NIk and ask him to post it. He has posted these laws before and he knows your company policies also.

    As I am sure they will require their linehaul guys to take their lunch before they get back in the morning with service freight...
    As far as requirements go,I believe it is a state by state issue..

    Here is the PCM to Management:

    Here is the PCM for - Northeast Region hourly and mileage-paid employees:

    I can tell You that, neither of which are being enforced! (Road or City)

    Instead:


    The scheduled meal period may be varied by mutual agreement.
    As implied in Article 30 - Section 2.

    ..so that settles it..meal breaks will be taken or at least logged....and now they are auditing our logs daily,sooo we need to get the word out to the folks...thanks!

    ...well I guess thats coming to an end.And my question is whats the reason for the turn around...safety,certainly a concern.But just call me skeptical with all the push to make service and time such a issue,holding up rddrs in their return to their terminals with the next days freight....a half to full hour delay has the possibility to really hamper the city side in hitting the streets...

    These PCM's came out a year and four months ago...

    There < not > being enforced!

    And obviously the IE dept. is < not > generating the so called reports, to local service centers...

    It's not Our job to spread the word!

    These are not company policy, until this understanding is uniformly communicated and enforced...

    Continue to do as You have been doing...

    Satisfying Your local service centers < mutual understanding >, until they communicate otherwise.

    So if you don't eat 5 times you are terminated?
    30 minutes uninterrupted meal break?
    Sorry we are not allowed a lunch break for RDDR's out of SOH since we are always late getting out anyway, if we stop for meals before our meet time under the 3/6 rule then our meet guys are upset that we are not at least 30-45 mins early. Most of our meet men leave their shops before schedule anyway since their freight is almost always ready.

    Now another question, if there is no work to be preformed "off the clock" does this apply to filling out DOT logs? I do mine daily as I always have, sometimes at home, sometimes at the terminal, so should I get paid for this? I say no but I am probably wrong according to this.

    You should always do your logs on company time. No different than filling out your pre-post trip inspection paperwork, which are part of the Federal regs.
