    UPS IMPOSES 70-HOUR WEEK

    UPS has imposed new work rules that could force exhausted drivers to work up to 70 hours a week during peak. Drivers deserve a strong union response, not another Hoffa surrender.

    UPSers are already working brutal peak season hours and delivering record volume. Now, UPS has unilaterally imposed a new method of calculating hours of service so they can force overworked drivers to work even more.

    Under DOT rules, the 70-hours-in-8-days hours of service method means that drivers can legally drive up to 70 hours per week in any 8-day period.

    The DOT rules have a loophole called the 34-hour reset rule. Anytime a driver is off for 34 hours, then the work-week resets and a new 8-day period begins.

    UPS plans to use this loophole to force drivers in some areas to work a sixth punch on Saturday, and to force all drivers to work up to 70 hours in a week until January 14 (the end of peak).
    New England Teamsters immediately objected. UPS management backed off and sent the following DIAD message to drivers. Drivers need to demand this response from the IBT and UPS nationwide.

    HOW HOFFA CAN STOP THE 70-HOUR WORK WEEK AT UPS

    UPS blindsided drivers this week by unilaterally imposing a new 70-hour work week through January 14.

    Management created the new 70-hour nightmare by changing its method of calculating Hours of Service to 70-hours-in-8-days, without any negotiations with the union.

    The company’s actions are unfair and unsafe. Our International Union can stop UPS. Here’s how.

    Step One: Demand Bargaining and File an Unfair Labor Practice Charge
    By law and by contract it is illegal for UPS to unilaterally make this change without bargaining with the union first.

    The Hoffa administration should immediately demand that UPS bargain over the issue, and file a national grievance and an Unfair Labor Practice charge with the National Labor Relations Board.

    Step Two: Tell UPS that the IBT Does Not Recognize the 34-Hour Restart Rule in Package
    UPS changed to a 70-hours-in-8-days Hours of Service calculation to be able to force some drivers to work a sixth punch, and to force package drivers to work up to 70 hours a week.

    Hoffa to Abney: 70-Hour Week Not Acceptable

    "Today, Jim Hoffa, Teamsters General President, wrote David Abney, CEO of UPS, about the company’s implementation of an 8 day/70-hour workweek for package car drivers. “I assure you the Union will make every effort at the bargaining table to ensure that its members will not have to pay the price for the Company’s mismanagement in the future.”

    Delivery drivers raise concerns about overtime
    The regional union for UPS service providers, Teamsters, sent out a statement saying UPS fails to plan ahead in hiring seasonal drivers and instead increases hours to compensate.

    It read in part "while the union and our members realize this is an extremely busy time of year, we also realize that ups is again putting profits ahead of the people."

    UPS responded saying in part "our employees' scheduled work week is in compliance with the department of transportation requirements."

    There are two mandated federal regulations concerning working hours.

    One is 60 hours worked in 7 days, the other is 70 hours worked in 8 days.

    Union employees are paid time-and-one-half for work above 40 hours per week.

    But Lucas, who worked about 20 years himself for UPS, said delivering packages is different than just driving.

    "We're concerned for the safety of these people that are on the road all day long and working long hours,” Lucas said.
